BY WINSTONE ANTONIO THE late tycoon Victor Cohen’s two daughters have obtained a certificate for a private prosecution against Waverley Blankets managing director Aaron Vico whom they accuse of fraudulently wresting the firm away from them using fake documents. The daughters, Amanda Berkowitz and Belynda Halfon are embroiled in a long-drawn legal battle against Vico who allegedly fraudulently took control of the company and its subsidiaries following the death of their father. They turned to private prosecution after seeing that their efforts for a public prosecution were being frustrated. The state refused to prosecute Vico citing lack of evidence. They have also written to President Emmerson Mnangagwa seeking his intervention to no avail. While almost all criminal prosecutions are undertaken by the State, a private prosecution is a criminal proceeding initiated by an individual citizen or private organisation instead of a public prosecutor. The first ever private prosecution in Zimbabwe saw former Bikita West legislator Munyaradzi Kereke being jailed for raping his 11-year-old niece in 2016. Now that Chief Law Officer in the Prosecutor General’s Office Justin Uladi wrote to Cohen through her lawyers, Mabundu and Ndlovu Law Chambers, on November 25 notifying her that request had been granted, Vico is now set to stand a criminal trial. Vico is accused of fraudulently altering the company’s shareholding and changing company documents with the help of corrupt employees at the Registrar of Companies to exclude other shareholders following Cohen’s death. The deceased family alleges that Vico created new shares amounting to 80% of the company and allocated these to himself. Cohen’s daughters claim the same fraudulent documents that were proved fake by forensic specialists were used to change the ownership of the company and to open new bank accounts. In her affidavit, Amanda, representing the family, stated that in terms of the company documents, Waverly Plastics shareholders are Debra Vico (33 percent), Amanda Cohen (33 percent), Belynda Halfon Nee Cohen (33 percent) and Stella Vicky Cohen (1 percent). Cohen told NewsDay yesterday that she was hoping for justice to prevail after the issuance of the private prosecution certificate. “We had reported the fraudulent activities at the police and National Prosecution Authority (NPA) after discovering fake documents and it has been more than a year without action as we battled efforts to have Vico prosecuted. Justice must prevail now,” she said. “Vico is using his political connections to plunder our late father’s estate. There is a possibility that the future can be better or worse than now. It can still remain like the present. Your present attitude can colour your future and influence it. Depending on disposition, the future is a place you can reach out by calculated actions. It can still show up while you passively wait for it. You can seize it with hope or apprehensively arrive at it. Whichever way, it will still show up. The attitude that you exhibit determines the actions you will take to face or seize the future. People who have succeeded in life have a natural inclination of hopefulness. Those with a default option of hopelessness always complain and harvest wind and tears. The sages summarise, “There is no medicine like hope, no incentive so great, and no tonic so powerful as expectation of something tomorrow.' Tomorrow is coming, hope for it, don't despair. Hope brightens your life Erasmus Makarimayi Filled with hope, one can anticipate the good to come. One can also expect the bad to show up in what is called despair. This can also be referred to as negative hope in that the unfortunate and unwanted are deemed to occur in preponderance to the desired positive outcome. Hope and despair will be respective contrast of optimism and pessimism. Merriam-Webster dictionary describes hope as the feeling of wanting something to happen and thinking that it could happen. It is the chance that something good will happen. It only takes your mental faculties to think of better things. BY MOSES MATENGA PARLIAMENT has summoned Local Government and Public Works minister July Moyo for grilling over the mass demolition of houses in Harare, which have brought President Emmerson Mnangagwa’s administration under the spotlight for human rights abuses. The august House, exercising its oversight function, also wants Moyo to give a ministerial statement explaining the rationale behind the demolitions. The also wanted a plausible explanation especially given that the demolitions were happening at a time Zimbabwe has received heavy rains and was in the middle of a major fight against the Covid-19 pandemic. About 200 houses were demolished by the City of Harare City in Budiriro, Harare, after the local authority obtained a High Court order to destroy the structures arguing they were illegally erected. The demolitions attracted censure from the civil society, opposition political parties and other stakeholders who questioned the timing of the move. Pictures of people braving the heavy rains, which included women and children crying and men battling to salvage and secure their belongings exposed to the vagaries of the weather, went viral on social media, triggering an outpour of sympathy. Some of the pictures showed furniture strewn all over in the mud, with only a few people having managed to ferry their property to safer places. Opposition MDC Alliance leader Nelson Chamisa, who visited the area on Thursday, described the demolitions as “callous, disproportionate and inhumane”. Parliament is keen to establish why the government allowed the demolitions to proceed in the current unfavourable weather conditions that have left thousands of people, mainly children exposed. The affected residents under the Tembwe Housing co-operative, chaired by a Zanu PF official and 2018 losing candidate in the party primary elections Caleb Kadye, were left to face the rains and exposed to waterborne diseases at a time COVID-19 cases were also soaring. Mbizo MP Settlement Chikwinya demanded answers on Thursday on why the government was allowing that to happen. “However, in respect of Section 51 of our Constitution which provides for human dignity and Section 52 of the Constitution which provides for personal security, I implore the Government to properly consider its timing when demolishing illegal houses,” Chikwinya said. “Just yesterday (Wednesday), illegal settlements in Budiriro were destroyed amidst rainfall and bad weather. It It is a story that's decades-old but still rings true today.
HBO documentary '40 years a prisoner' revisits Philadelphia in 1978 when the black liberation group Move was involved in an epic police siege and shootout.
A police officer was killed in the shootout for which nine Move members were convicted and sentenced to 30 years to life.
The Philadelphia police said they received complaints from neighbors, under orders from mayor Frank Rizzo, who ordered the group to vacate. But the situation escalated into violence.
The story documents the past event and follows Mike Africa Jr, whose parents were arrested in the raid and how he tried to free them.
\"The story captures the deep-seated racism and issues in the city of Philadelphia that we can see, that we can really begin to make some changes on,\" said Africa.
\"'40 Years a Prisoner' captures the human-ness of us, of who we are, and it shows who we are versus the image that we've been portrayed as. And that is the element that I think is so valuable in it, because people get to see us for us, who we are and how we interact with each other, the love we share with each other.\"
The film shows the shocking footage of one of the Move members, Delbert Africa, is beaten by three police officers while he is unarmed, showing how police brutality and systematic racism ensues to this day.
Director Tommy Oliver finished editing the movie in June, just days after George Floyd was killed under the knee of a police officer in Minneapolis.
\"It's a cautionary tale in a big way, because when we forget our history, we're doomed to repeat it. And this was something that, like you said, you didn't know about it, your parents barely knew about it,\" said Oliver
\"And here we are fighting for the same thing some 40 years later, fighting against police brutality, wrongful incarceration, systemic racism, abuse of power.\"
The siege ranks as one of the most violent clashes of the black liberation struggle involving Move and the Black Panthers in the late 1960s and 1970s.
But systemic racism and police brutality are not the only themes of the film.
\"But it's also a story about love. It's a story about a child's love. It's a story about romantic love. It's a story about the love of a city,\" Oliver said.
It also ends on a somewhat upbeat note with his parents released 40 years later and the film captures the first hug between mother and son.
With many people still nervous to travel, even under lockdown level one, here's how you can make the most of staying home.
Among the thousands of people fleeing the five-week-old conflict in Ethiopia's Tigray region are a few dozen men, women and children from Eritrea, one of the world's most authoritarian states.
They were already living as refugees in Tigray, which had long been a safe haven for them during years of conflict and repression in Eritrea.
But when Ethiopian Prime Minister Abiy Ahmed's government launched a military operation against Tigray's ruling party, the Eritrean refugees' illusion of safety was shattered as violence escalated around their camps.
\"Suddenly soldiers came to our camp and they started shooting,\" Kheder Adam told AFP in a Sudanese refugee camp. \"The situation was very serious. There was a lot gunfire.\"
Kheder and his family had originally settled in one of the refugee camps in the Sheraro area of Tigray near the Eritrean border around two years ago, he said.
For years, Ethiopia and Eritrea had been officially in a state of war.
In 2018, Abiy took power, ending years of political dominance by the Tigray People's Liberation Front -- sworn enemies of Eritrean President Isaias Afwerki.
Abiy and Afwerki signed a historic peace agreement that same year, winning the Ethiopian leader the Nobel Peace Prize.
After the dramatic shift in alliances, Abiy's forces launched their operation in Tigray on November 4, Eritreans who had long benefitted from protection in Ethiopia appear to have become a target.
Since then, a few Eritrean refugees have managed to escape to Sudan.
The UN, meanwhile, has expressed fears for the safety for those still in Tigray, home to some 96,000 Eritrean refugees living in four refugee camps.
- 'Refugee again' -
Kheder, 30, who was separated by the recent violence from his wife and two children, aged three and one, was among several Eritrean refugees interviewed by AFP at a reception centre for new arrivals from Ethiopia in Hamdayit on the eastern Sudanese border.
\"Some of the soldiers were Eritreans, some of them were (Ethiopian) federal soldiers,\" said Kheder, of the attack on the camp in Tigray.
\"They were shooting at all people. All -- women, men, children,\" he said.
His comments were echoed Friday by a US State Department spokesperson -- though the Ethiopian government, a US ally, has denied the claim.
\"I feel worried and sad to be a refugee again. There I was a refugee, and here I am also a refugee. It's really difficult,\" said Kheder.
He cited Eritrea's notorious policy of universal, indefinite conscription as one reason why he fled his home country in the first place.
\"They forced us\" to undergo a mandatory national service in Eritrea, he said. \"That's why we decided to go to Ethiopia.\"
The Eritrean regime once used its war against Ethiopia to justify its system of universal conscription.
But the system remains in place despite the fact that the war ended in the year 2000, followed by the peace agreement in 2018.
