Chitown faces hurdles in illegal structures demolition

BY HARRIET CHIKANDIWA Chitungwiza Resident Trust (Chitrest) yesterday moved in to block Chitungwiza Council from executing random demolition of houses through their lawyers who demanded a report on the regularisation of the stands which they claimed had been done by the affected individuals. This was after a leaked memorandum dated January 12, 2021 announced that there were plans to demolish over 11 000 illegal structures in the dormitory town, subject to a court order. Chitungwiza Municipality has over the years threatened to demolish thousands of houses built on spaces reserved for clinics, churches, schools, cemeteries, recreational activities, roads and under high-voltage electricity pylons. Chitrest, through its lawyers Tinashe Chinopfukutwa and Idirashe Chikomba yesterday wrote to council demanding a list of the stand numbers to be demolished instead of the demolitions being executed as a random exercise. The lawyers noted that council’s director of works acknowledged the need for council to obtain valid court orders authorising the demolitions. However, last year the council demolished houses without obtaining a court order. “In terms of section 74 of the Constitution, Chitungwiza Municipality is enjoined to obtain court orders authorising the demolition of all the houses specified in the Chitungwiza demolition report of 12 January 2020. “We note that the report which specifies areas to be demolished does not identify the individual stand numbers and properties targeted for demolitions. The demolition report merely makes globular identification of sites to be demolished without identifying the individual stand numbers or properties,” read the letter from Chitrest. “Our clients also advise us that several residents, whose houses are located in the various sites targeted for demolitions, were invited by the Chitungwiza Municipality to pay regularisation penalties and paid for the purchase of the properties.” The lawyers argued that the residents duly paid the regularisation penalties and the purchase prices in terms of the offer extended to them by council. “Should council proceed to demolish the houses in terms of a report of 12 January 2021, then residents, who paid regularisation penalties, risk their houses being unlawfully demolished as the identification of sites targeted for demolitions does not specify which individual property is being targeted for demolition,” they said. The lawyers added: “In any event, council cannot reprobate and approbate by requesting and receiving regularisation penalties and stand purchase price in one breadth and in another breadth move in to demolish the same properties in respect of which regularisation penalties were paid.” The lawyers said should the demolition report not be revised, they would institute legal proceedings for the same to be set aside. U.S. regulators on Monday revoked emergency authorization for malaria drugs promoted by President Donald Trump for treating COVID-19 amid growing evidence they don’t work and could cause serious side effects.

Citing reports of heart complications, the FDA said the drugs’ unproven benefits “do not outweigh the known and potential risks.”

It didn't shorten the time of infection and it didn't reduce the risk of death

In the following article Professor Malik Simba, an historian at California State University, Fresno describes his professional and personal odyssey that led to the writing of his book, Black Marxism and American Constitutionalism: From the Colonial Background through the Ascendancy of Barack Obama.

I am a Marxist historian.  I use Marxist analysis, which argues that class struggle is the locomotion of history.  That theory, I believe, facilitates a critical understanding of the American Constitution and the American legal system and is the analysis which informs the writing of my new book, Black Marxism and American Constitutionalism: From the Colonial Background through the Ascendancy of Barack Obama.  I embrace Marxist analysis  because I believe it best answers critical questions about the nature of American law and the American judicial system which affect the lives of thousands of African Americans on a daily basis.  My embrace of Marxian analysis evolved from my own reading and study of Marxist and non-Marxist texts on history, American constitutionalism, and the American judicial system.  It also grew from a series of experiences over my life that have led me to question the commitment of the American legal system to equal justice for all.

I have always been fascinated with the concept of justice and equality.  I was born in Lexington, Kentucky in the era of overt racial segregation.  I can still remember when my mother stood protectively close to my siblings and me whenever we went downtown because she knew we would be subject to verbal assault by white shoppers and store owners.   When we moved to Denver, Colorado in 1954 my family entered a city which supposedly had avoided the racial discrimination and violence that marked Kentucky and the rest of the South.  Nonetheless, I still vividly recall my first encounter with racist police when I was 12 years old.  That encounter was intimidating and violent.

While playing in the alley behind our home, my friends and I exploded illegal firecrackers.  All

When it Rains it ¨Pours

Heavy seasonal rainfall causing devastating floods since June have impacted over 700,000 people across South Sudan — already in a precarious situation due to food shortages from an overwhelming locust infestation and a health crisis from the global Covid-19 pandemic.

A large part of the country is under water with the Nile River at its highest level in 50 years. Adol Kur Akuei, a mother of 7 children who has been displaced by floods, is overwhelmed by the catastrophe, \"In the village I come from, called Mathiang, the floods were devastating. They destroyed everything. They destroyed our houses, killed our cattle, our crops and our source of livelihood.\"

The World Food Programme has been providing food assistance to more than 500,000 people in flood-affected areas of South Sudan as the threat of famine climbs within the country.

Peter Smerdon, a spokesperson for WFP, shared his concerns, \"We were already under pressure in South Sudan because of conflict and because of the high levels of displacement and now with the added burden from flooding, donors need to step forward. But donors themselves, of course, are struggling in their own countries with the pandemic COVID-19. So it is difficult for them to give at this very difficult time.\"

With the floods compounding the rise in food prices that have resulted from coronavirus related restrictions and the earlier loss of crops to locusts, the WFP seeks to raise 58 million US dollars to continue providing relief.

Taylor Family

Before she was a hashtag or a headline, before protesters around the country chanted her name, Breonna Taylor was a 26-year-old woman who played cards with her aunts and fell asleep watching movies with friends.

Now, as protesters around the country have taken up her name in their call for racial justice and an end to police violence, Taylor's friends and family remember the woman they knew and loved: someone who cared for others and loved singing, playing games, cooking, checking up on friends.

Former French president Nicolas Sarkozy goes on trial on Monday

This is the second time the trial are set to begin after the November 23 session was postponed. One of the three defendants, the former high magistrate Gilbert Azibert, had requested for a postponement, citing his fragile health in the relation to the ongoing coronavirus epidemic.

The court rejected his request last Thursday. Gilbert Azibert should therefore appear in person for the hearing today. This marks another fresh attempt to kick start these proceedings. 

Nicolas Sarkozy faces a ten-year prison sentence and a million euros fine for corruption and influence peddling, like his co-defendants who were already tried in addition for violation of professional secrecy.

The former French president together with his lawyer Thierry Herzog are suspected of having, tried to bribe Gilbert Azibert, who was then in charge of Cassation Court. It is alleged that Nicolas Sarkozy and Thierry Herzog used a false identification as Paul Bismuth, who happens to be a former high school friend to the lawyer.

According to the prosecution, Nicolas Sarkozy was seeking to obtain classified information to influence proceedings before the high court related to the Bettencourt case - in which he had obtained a dismissal at the end of 2013.

In return, he would have given Gilbert Azibert a \"boost\" for a prestigious position in Monaco, a position he never obtained.

Investigators had from 2013 been wiretapping conversations between Sarkozy and his lawyer Thierry Herzog as they delved into allegations of Libyan financing in Sarkozy’s 2007 campaign.

The CDC report stated that a third of Americans surveyed have used risky cleaning practices to stop the spread of the COVID-19.

Those people who were surveyed acknowledged they used high-risk cleaning practices to prevent the spread of COVID-19.

More likely these individuals reported health problems that were closely related to their cleaning practices more so than the COVID-19.

Most people also said they knew they should keep cleaning products out of the reach of children, but only 54 percent knew that hand sanitizers should be kept in a place that children could not reach.

The CDC recommends that people always read the instructions on cleaning products.

“This isn’t a difficult decision; it’s the only decision,” said State Fair General Manager Jerry Hammer in the announcement that the Great Minnesota Get-Together will not be held in 2020 due to coronavirus health risks.

The decision was announced today following a meeting of the board of managers of the Minnesota State Agricultural Society, which governs the Minnesota State Fair.

Organizers said that in a normal year, preparing for an event the scale and scope of the Minnesota State Fair is a year-round operation and a mammoth undertaking; in the midst of a global pandemic, it is impossible.

“We’re extremely grateful for the understanding and support of everyone who makes the State Fair possible–especially the millions of fair fans from around the globe,” Hammer said.

The Great Minnesota Get-Back-Together is Aug. 26 – Labor Day, Sept. 6, more information.
